I would love to just be able to pay all of the bills up to date at least. If I try for bankruptcy, I would not be able to actually catch up, just get rid of the garnishments….I would still be behind on the current things. Please help

Story

My name is Crystal. I am 42 years old and been a medical assistant for 22 years now. I am currently working Radiation Oncology. I absolutely LOVE what I do. Currently though, I am in a horrific bind.

Here is how it all started from my point of view.

I obtained a 2005 Pontiac Grand AM through Wells Fargo Financial back in 2007. Well, in 2009, I was in a bad situation and had to give up the car. I just could not afford it. I voluntarily gave the car to Wells Fargo Financial thinking that was my best option. I was too far behind to worry about it. I was under the impression that this would be better on my credit and that I would be free and clear.

Jump ahead to July 25, 2023. I had to have surgery as to stop a bleeding situation and had to miss 6 weeks of work. I was awarded 60% of my pay during that time. I paid what I thought needed to be paid and moved along. I went back to work early September.

Well, I had gotten behind on my car during that time and had trouble catching up. I figured I would use my bonus in December to catch up. My bonus was taken from for a reason that was unknown to me. I asked HR what happened. They told me to contact the courts as it was out of their hands. I had no idea what was going on. I get ahold of the courts. They send me a copy of the paperwork.

I had never realized that there was a lawsuit filed in July of 2014 against me. They had decided to garnish my wages and were taking 25% post taxes from me all of a sudden. I went to see a lawyer, he told me that if I could not afford the garnishment, I could not afford him. So I decided to do whatever I could to stop this. I went and filed to have a court date. I went to the hearing but that was not until 3/15/2024. At this point, I am out of funds and borrowing from any means necessary. Wells Fargo Financials lawyer did not show so the judge said that she was stopping the garnishment and I would pay no longer.

Whew! Now to catch up!

Well, the car is behind. The rent is behind and there are still late fees stacking up. The electric bill is behind. I cannot get back on track from all that money they took from me. I am the only income in my house and have run out of options.

NOW, they renewed the lawsuit in June of 2024 and it is for $11,800.
I then got a summons yesterday from the hospital lawyers. The facility that I had my surgery at. It states that I am being sued for the money that I owe them. They want to garnish my wages as well if not paid in full. I am at a loss and so far behind, I am drowning and on the verge of eviction once again.

Anything will help me to get back on track. Currently the car is behind, (even though I have been making payments over the last few months) there is an incredible amount of late fees. They will not help me until I am caught up. I am currently $1400 behind and they want to repossess it. I am currently behind on rent for $1400 and the electric is out of control. I am even without car insurance and my registration is currently suspended. Tags are due next month. (PS-I am the float for the company I work for, and they have no idea either)

I need help. I do not have the funds even to do bankruptcy, and if I did, I would lose the car I have as I am behind on it. I would also still be behind on the electric and the rent so I need more than just the bankruptcy at this point.
