To Those who can’t stand injustice

Greetings to you firstly. I do understand what the aim of this platform is. I do have quite a few ideas, even forgot some of them but they’ll return to me, from a gadget that helps wash and remove polish from your vehicle and it doesn’t need electricity or battery, and if up scaled, it can produce cheap clean electricity.

A natural water sanitation company that will sell clean affordable water to Government or straight to the people.

And a fertilizer to help crops grow more naturally and quickly. There are quite a few Ideas that run through my mind almost monthly.

My mother also wants to open a food restaurant, we all brag about our mother’s cooking but believe me when I say, even the people agree that she knows her stuff around a kitchen

But the reason I have written to you is more important to me than pursuing any of these ventures right now.  My dad lies in an unmarked grave because we can’t afford to erect a tombstone for him.

So, if you may please take a moment to read my story.

My name is Mzwandile Mthombeni, you may refer to me as Mzwa. I live in South Africa in a small town in Mpumalanga called Kwa-Mhlanga, if you were to Google Esther Mahlangu that’s where I reside. I hope that this letter of Plea for Assistance finds you in good health and spirit, if you may please award me a moment of your time to explain why I am writing to you. I am reaching out to you with a sincere and genuine plea for financial assistance. It is not easy for me to express the emotional and psychological issues we have experienced as a family because of greased palms, our once red-blooded. Happy. Striving. Simple-minded lives turned gloomy by antidepressants we can hardly afford, while our police force in Kwa-Mhlanga has a silent code amongst themselves, a slogan if you may, and I quote “JOB DONE, OR NO JOB DONE, I GET PAID”. We have been intentionally and deliberately denied justice, and purposefully made to suffer psychologically and financially by SAPS (South African Police Service)

This letter was supposed to find its way to you in November 2024 but after this incident, we’ve grown used to spending Christmas without the Bells Jiggling on Christmas day and no fireworks lighting up the sky on New Year’s Day and going to bed with only soft porridge. A man once said I cannot recall correctly if it was Orwell or Bukowski who said: We wake up. Force feed. Force the toilet. But I cannot recall if, Forcing Yourself To Remember To Breathe was in there.

This incident has not only cost me the best years of my youth, I have missed out on countless opportunities for self-development and career aspirations because of the lack of funds to take advantage of these opportunities, this has also cost us psychologically from chronicle anxiety, Insomnia, depression and has re-triggered my epilepsy after more than 13 years of not having any epileptic episode (I hear it can kill). The worst thing is that an honest man, hardworking, humble man suffered a stroke because of this matter and never woke up till he was buried (they killed my Dad).

I have exhausted almost every search result on Google, Universities, and Pro Bono Organizations looking for a Pro Bono Lawyer. I now turn to you with a sincere and genuine plea for Assistance to pay for a lawyer to help us find justice for my late father, what could be even better is if you know a lawyer in South Africa who’s not afraid to take on SAPS (South African Police Service)

As I even write to you my stomach is empty, but I am used to it by now which has caused me to be malnutrition, my younger brother doesn’t even have a proper school uniform and if things continue this way, he won’t be able to attend his Matric Dance/Prom Night.

All of this is because of corrupt police officers, I will tell you a bit more about they’re corruption below.

In late 2017 my late father’s mini-bus and only means of sustenance

was hijacked by five assailants. I wouldn’t be writing to you if it was just an everyday car.

Three Officers oversaw the case.

Officer 1: Had no resources to do his job

Officer 1: Had to collect some information based on the driver’s statement and vehicle’s tracking report.

He had to go to a place called MBS to find out if the suspect even showed up, what time did the driver show up there and what time did they drop the driver off at Nkangala Police Station.

BECAUSE THE TIME THE TRACKING COMPANY CALLED AND HIS CALL TO US IS JUST SIX MINUTES APART

And to also find out what was the driver’s state of appearance when he arrived at these places. Because when the driver showed up at Kwa-Mhlanga Police Station he had no shoelaces on, when asked where they were, he said that they were used to tie him up. But the Officer he met with at Nkangala says he had them on when he arrived there.

Officer 1 was asked to go get that statement straight from the Officer at Nkangala.

According to the tracking report two stops were made along a road, people who are familiar with that road say there are at least two Patrol Stations, so we asked Officer 1 to please go there and find out if my father’s vehicle might have made a stop at anyone of them.

Officer 1 was also asked to contact MiWay an insurance company to find out what the driver told the insurance inspector. Which made MiWay refuse to pay out the insurance claim based on what a thief told them

� Officer 1 was also asked to complete two 205 reports one for the driver’s cell phone records, because the tracking company called at 22:23 to tell us that the GPS Box was located in a field, six minutes later 22:29 the driver called us from the Station in Nkangala to say that he was hijacked.

The second 205 report was requested by the Prosecutor, because the vehicle was spotted by one of SANRAL’S cameras in Pretoria the Prosecutor asked him to find more footage from SANRAL.

ALL THIS INFORMATION WAS NEVER COLLECTED BY OFFICER 1, BECAUSE HE DOES NOT HAVE TRANSPORT. BUT HAS TRANSPORT TO TAKE HIS GIRLFRIEND OUT ON DATES.

It TOOK OFFICER 1 ALMOST TWO YEARS TO GET THOSE CALL RECORDS AND WHEN HE DID, HE MADE THEM THE WRONG DATE. BUT ACCORDING TO THE OFFICER WHO ANALYSYS CALL RECORDS IT COULD TAKE ALMOST THREE MONTHS BECAUSE OF COVID-19, THERE WAS NO COVID-19 IN 2017, 2018, 2019. THAT MIGHT MEAN OFFICER 1 KNEW WHAT WAS IN THOSE RECORDS

Officer 2: was the suspect’s personal defence Attorney.

� After the incident, two eyewitnesses came forward and gave their statements to the Police.

Firstly, they both claim to have seen the driver standing around a Bus Stop in Kwa-Mhlanga around the time the driver claims he was Hijacked.

� The first eyewitness states he asked the driver, where the vehicle was? the driver responded at the carwash, okay.

� The second eyewitness also asked the driver about the vehicle and the driver responded, that the vehicle went in for service. That vehicle was never due for any service.

� After a few weeks or a month, the two eyewitnesses called my mom, and said they had tried everything to help us, my mom asked what they meant. The two eyewitnesses went to Officer 2 and told him that, the person who was supposedly hijacked and should be cashless because he is now jobless is throwing a party at the Taxi Rank buying everyone Fish&Chips. Officer 1 responded, that is Hearsay bring me evidence, Officer 2 is asking civilians to bring him the evidence.

� The place where this party took place is a place that if you stood outside their offices, you could see the place. Officer 2 wholeheartedly refused to go anywhere near that fish&chips franchise

� My mom then went to confront Officer 2, about what was Hearsay to an Investigating officer, Officer 2 responded, that anyone can come here/Police Station and say someone did something. Isn’t that how arrests or investigations against people are made?

� After that we received information that the driver was now spending some quality time in Menlyn an expensive Mall we told Officer 2 this and we got the same response Hearsay.

� Officer 2 was the Officer who told the driver he was free to go, in front of him were six documents, 3 statements one from my mother and the other two were from the two eyewitnesses and two tracking reports and the driver’s own handwritten statement.

All the other documents including the driver’s own statement contradicted his story (Those documents including his statement, said this is nonsense). SO, ON WHAT DID OFFICER 2 BASE THIS YOUR FREE TO GO ON?

� A meeting was held in 2021 where Officer 2 was asked about the 3 eyewitness statements he resorted to calling them circumstantial evidence because he refused to follow up on those statements. All those statements could have been proven to be true or false, but he chose not to.

� We got in contact with the driver’s girlfriend, who told us that they had broken up because the driver showed up one day with a hand full of cash, we told one of the other Officers I have not mentioned here about that and he also told me that is Hearsay in Court. But he deals with informants.

� Officer 3 was tasked with finding out from the now Ex-girlfriend how was the driver’s state of appearance that night and all the above-mentioned information.

� Officer 3 only went there to take a look at her for himself because he had nothing to report back, besides that the driver only told his girlfriend the day after about it.

� Officer 3 was also asked to contact MiWay and to find out where the driver was at, using Cell Towers to Ping the driver’s cell phone, because the driver was using his phone the whole time this hijack of his was taking place, he also called my mother and said he might have been involved in an accident, but the problem is according to his own handwritten statement he was placed in a different car, so how is it that he is making calls on behalf of a vehicle he is not in.

AND MAY I ADD THE FACT THAT THE DRIVER CLAIMED TO BE UNCONSCIOUS THE WHOLE TIME THE HIJACKING TOOK PLACE, AND NOW THE SUSPECT IS CHANGING THE VENUES, TO WHAT AND WHERE I DON’T KNOW

But the one thing Officer 3 did right was to retrieve those call records and according to them the driver was in communication with a suspected crime syndicate working around KwaMhlanga that day. Because some of the Officer’s whisper in passageways that the driver was communicating with some very dangerous people, that would mean they know who these people are.

Like I said before I wouldn’t bother you with this if it was just a normal everyday vehicle but that was how we placed bread on the table. My father worked hard to give his family a way to put bread on the table when he was gone. Unfortunately, he died that year from a stroke caused by this matter

while some lazy boy lives his life from all that hard work as a teacher my father put in, so if not for us but at least for my late father to receive some form of justice.

AND MAY I PLEASE ADD THE FACT THAT THE PROSECUTOR REFUSED TO TAKE THIS CASE TO COURT BECAUSE ALL OF THE EVIDENCE HE ASKED THESE OFFICERS TO COLLECT WAS NEVER COLLECTED.

And in that meeting that was held in 2021, Officers 2 & 3 and the Brigadier agreed that the driver was lying, but they still sat there and did nothing, no arrest warrant or anything was issued.

The reason I am asking you for assistance is that we would like to file a Lawsuit against SAPS under the SAPS policing objectives in accordance with the provisions of Section 205 of the Constitution which are to

• Prevent, combat, and investigate crimes.
• Maintain public order.
• Protect and secure the inhabitants of South Africa and their property.
• Uphold and enforce the law.

And not just laze around their offices and sabotage cases
